1. What SellTheSpot Is
SellTheSpot (“the Platform”, “we”, “us”) is an introductory directory and marketplace connecting individuals who own or control physical surfaces, clothing, gear, or objects (“Creators”) with businesses and individuals seeking physical advertising exposure (“Sponsors” or “Brands”).
2. 0% Platform Fee & Direct Payments
SellTheSpot charges 0% platform transaction fees. SellTheSpot does not process, intermediate, hold, or escrow sponsorship payments. All payments are conducted directly between the Sponsor and the Creator via the Creator's independent payment link (such as Stripe, Dodo Payments, Wise, Polar, or PayPal).
Because transactions occur directly, payment disputes, chargebacks, and refund requests are governed by the Creator and their chosen payment processor.
3. Creator Ownership & Accuracy
When publishing a sponsorship opportunity on SellTheSpot, Creators agree that:
- You own, wear, or have legal authorization to display third-party branding on the specified physical object, clothing, vehicle, or space.
- All photos, spot placement boundaries, estimated audience reach, and dimensions represent your actual physical item.
- The price and currency attached to your spot match the payment amount requested on your external checkout link.
4. Creator Fulfillment Responsibility
Creators are solely responsible for fulfilling the accepted sponsorship. This includes:
- Applying the brand logo or sticker accurately in the designated spot;
- Maintaining visibility of the brand for the agreed-upon duration;
- Ensuring the item is displayed in the environments described in the listing (e.g. coffee shops, race events, conferences).
SellTheSpot provides the matching directory and does not supervise creator activities, attend events, or guarantee physical performance.
5. Acceptable Content & Physical Safety
SellTheSpot is strictly for lawful, physical sponsorships. Listings and brand submissions must not contain:
- Hate speech, harassment, defamation, or sexually explicit material;
- Fraudulent, deceptive, or misleading claims;
- Trademark or copyright infringement;
- Illegal drugs, regulated firearms, or unlawful goods;
- Defacement or unauthorized tampering with public property or third-party property without permit.
6. Problem Reporting & Account Suspension
If a Creator accepts payment but fails to fulfill the agreed physical sponsorship, Sponsors can submit a report through our Problem Reporting tool. While SellTheSpot cannot forcibly reverse external financial transactions, we investigate reports and reserve the right to remove listings, suspend creator storefronts, and assist sponsors with verification documentation.
7. Sponsorship Results Disclaimer
SellTheSpot provides a marketplace for discovering and arranging sponsorship opportunities. We do not guarantee views, impressions, clicks, engagement, sales, followers, funding, acquisitions, or other business results from any sponsorship.
Creators are responsible for accurately describing their sponsorship placement, duration, showcase plans, and included deliverables. Sponsors should review the listing and sponsorship details carefully before submitting a request or making a payment.
8. Limitation of Liability
To the maximum extent permitted by applicable law, SellTheSpot and its operators are not liable for indirect, incidental, or consequential damages arising from physical wear-and-tear, loss of sponsorship revenue, third-party payment gateway failures, or creator fulfillment breaches.
